Iowa law favors frequent and continuing involvement of both parents in a child’s life, unless there are compelling reasons why one parent should not have contact with the children. There are two types of child custody:
- Legal custody, which includes making important decisions about medical care, education, religious upbringing and extracurricular activities at school
- Physical care, which includes providing a home and routine care for the child
Legal custody is typically shared. In most cases, one parent will have primary physical care of the child, while the other has visitation according to a written schedule. However, parents can seek joint physical care.
Our lawyers have extensive experience crafting child custody and visitation plans that clearly define how parenting time is shared. Our goal is to work closely with you to draft a plan that is both clear and flexible.
Establishing Paternity Under Iowa Law
If a child is born out of wedlock, a paternity action may be needed to give the mother the right to obtain child support and the father the right to have visitation.
A child born during marriage is presumed to be a child of both the husband and wife. If you have reason to think you are not the father, however, our lawyers can help you prove that you aren’t.
